General Provisions
These Terms of Service (hereinafter: the “Terms”) set out the rules for using the website available at agbiindie.com (hereinafter: the “Service”), operated by AgBi in the course of creative activity conducted under the name Project Indie.
Use of the Service constitutes acceptance of these Terms in their entirety. Persons who do not accept their provisions should refrain from using the Service.
Definitions
- Service — the AgBi website available at agbiindie.com, together with all its subpages.
- User — any natural person, legal person or organisational unit without legal personality visiting the Service.
- Administrator — AgBi, who operates the Service and is responsible for its content.
- Content — all textual, graphic, video and audiovisual materials published on the Service.
- Collaboration — creative activity, whether for remuneration or free of charge, performed for the benefit of third parties, as described on the Service.
Rules for Use of the Service
The User undertakes to use the Service in accordance with applicable law, generally accepted standards of conduct and these Terms.
In particular, the User shall not:
- reproduce, duplicate or distribute the Content without the Administrator's prior written consent;
- undertake any action liable to disrupt the proper functioning of the Service;
- engage in scraping, automated data collection or any other technical circumvention of the Service's security measures;
- use the Service for commercial purposes without the Administrator's prior consent;
- impersonate the Administrator or Project Indie in public.
Copyright and Intellectual Property
All Content published on the Service — including texts, graphics, logotypes, video recordings, descriptions, reviews and analyses — constitutes the intellectual property of the Administrator or of entities that have granted the relevant licences, and is protected under the Polish Act of 4 February 1994 on Copyright and Related Rights.
- Quotation of excerpts of the Content is permitted, subject to the mandatory attribution of the source and authorship (AgBi / Project Indie).
- Opinions and game reviews published on the Service express the subjective viewpoint of the Administrator and may not be treated as marketing material without prior written consent.
- Logotypes and graphic marks of the indie game developers referred to on the Service remain the property of their respective owners.
Collaboration and Business Inquiries
The Administrator provides creative services to independent development studios and game publishers, including in particular:
- the preparation of reviews and analyses of indie games;
- the promotion of titles on the YouTube, Kick, Steam and Discord platforms;
- the localisation and adaptation of promotional materials for the Polish market;
- Polish ambassadorship and brand representation within the gaming community.
The detailed terms of any Collaboration, the remuneration and the scope of services are determined individually in each case and recorded in a separate agreement. Information about services published on the Service does not constitute an offer within the meaning of the Polish Civil Code.
Exclusion of Liability
The Administrator makes every effort to ensure that the Content published on the Service is accurate and up to date. Notwithstanding the foregoing:
- the Service is made available on an “as is” basis, without any warranty as to its completeness or the continuity of access thereto;
- the Administrator shall not be liable for any decisions taken by the User on the basis of the Content;
- the Administrator shall not be liable for the content of external websites to which links are provided on the Service;
- the Administrator reserves the right to suspend the Service temporarily for technical reasons, without prior notice.
Protection of Personal Data (GDPR)
The controller of personal data provided in e-mail correspondence is AgBi (Project Indie), contact address: agbigamesstudio@gmail.com.
- Personal data are processed solely for the purpose of responding to the inquiry submitted (legal basis: Article 6(1)(b) and (f) of the GDPR).
- Personal data are not disclosed to third parties, nor used for marketing purposes, without the consent of the data subject.
- The User has the right of access to their data, and the right to rectification, erasure and data portability.
- The Service does not use cookies or analytical tools. Only the User's language preference is stored in the browser's local storage (localStorage), as this is necessary for the proper functioning of the Service; that information is not transmitted to the Administrator.
Requests concerning personal data should be addressed to the Administrator at the address indicated above.
Amendments to the Terms
The Administrator reserves the right to amend these Terms at any time. Amendments shall take effect upon publication of the updated version on the Service. The date of the most recent update is displayed at the top of this document at all times.
Continued use of the Service following the introduction of any amendments constitutes acceptance of the amended Terms.
Final Provisions and Contact
In matters not governed by these Terms, the provisions of Polish law shall apply, in particular the Act of 23 April 1964 — the Civil Code, and the Act of 18 July 2002 on Providing Services by Electronic Means.
Any disputes arising from the use of the Service shall be settled by the court having jurisdiction over the Administrator's place of residence. This provision neither excludes nor limits the rights of a User who is a consumer under mandatory provisions of law.
